This licensing arrangement applies if you are creating proprietary applications / derivative works for which you will receive revenue for license fees, consulting, or other arrangements in which you receive monetary benefit from the use of GPULib. A Tech-X license agreement covering this option is available for your review here. Licensee shall not publicly disclose data or graphical representations of data or results or benchmarks generated by GPULib in any way in journal articles, conference presentations or proceedings, web publications, seminars, press releases, or other manner without inclusion of the phrase, “GPULib was developed by Tech-X Corporation,” along with some citation of the documentation, the web page http://gpulib.txcorp.com, or both. Tech-X Corporation will not release this information to any third party, as stated in our Privacy Policy. Note: this product is covered by License Exception TSR (Technology and Software Under Restriction) by the U.S. Department of Commerce for export only to the buyer of the software. Under this exception, the following is prohibited: 1) re-export or release the software or the source code for the software to a national of a country in the list of embargoed countries (currently found on the US Department of State website at http://pmdtc.org/country.htm); and 2) Export to Countries in the list of embargoed countries (currently found on the US Department of State website at http://pmdtc.org/country.htm) the direct product of the software, if such foreign produced direct product is subject to national security controls as identified on the U.S. Commodity Control List. Written approval must be obtained by Licensee from Tech-X prior to any and all re-exports of this software, source code or direct products of this software to ensure it meets the requirements of this exception. The Licensee may not use this software specifically for the development or production of space qualified traveling wave tubes (also known as helix tubes or TWTs), microwave solid state amplifiers, microwave assemblies, and traveling wave tube amplifiers operating a frequencies equal to or less than 31 GHz (or as currently defined in the United States Munitions List (currently Part 121, found on the Department of State website at http://www.pmdtc.org/docs/ITAR/22cfr121_Part_121.pdf)) The Licensee may not use this software specifically for the development or production of Directed Energy Weapons (as currently defined in the United States Munitions List, Category XVIII (currently Part 121, found on the Department of State website at http://www.pmdtc.org/docs/ITAR/22cfr121_Part_121.pdf)). |
